194 ABORTION LAW BY "DO-IT-YOURSELF"

(president of Life Science & Pisa-Livorno)
1. A brief history of abortion.
legal history of our country, like all other countries with Christian traditions (it is also the case for the laws of Islamic countries), the procured abortion has always been considered an unlawful criminal penalties, as consciously directed action voluntarily suppress the life of a human being in the womb.
and some ancient pagan cultures the killing of children, even in the womb, was often linked to magical practices. Rituals of this type survive today in large parts of Africa but also in Cuba (rites "voodoo"). Abortion, however, was sometimes practiced, though in violation of civil and religious, even in civilized countries and converted to Christianity by individuals, mostly women, placed at the margins of society with the use of poisons or hallucinogens, or with instruments often fatal for those who submit (see Francis Corners, History of abortion in the world, "Ed Mark, Tavares (UD) 2004, p. 8 et seq.).
Abortion is legalized for the first time in 1917 (together with the introduction of divorce) with the advent of communism in Russia, in perfect line with the 'Marxist utopia where it emanated from that family, as well as the property, the right, etc., is merely a construction of bourgeois capitalism, which is an obstacle to the creation of a classless society without divisions and roles that must be eradicated to make room for extra-marital unions (see Marx, Collected Works Filos. Youth, cit. in P. Giorgio Loiacono SJ, "Marxism", Ed Domin.Italiane, Naples, 1967).
USSR will remember, in addition to the millions of starvation, for the "purges" and the infamous "Gulag", even the millions of children left to rot in state orphanages.
In 1937 abortion was introduced, and here is a case in Nazi Germany as a result of the consistent policy pursued with determination to eugenics, Hitler and his entourage to its extreme consequences known to all.
After the war, abortion is legalized in all countries of the "Iron Curtain" in which the Soviet Union militarily impose its "model".
Even Communist China in 1957 and is adjusting its policy of obsessive "planning" family the lead, with a law of 1979 that forced abortion in women expecting their second child. This policy has borne the brunt of millions of girls, who have been denied birth, evidently considered less useful to the Chinese company (the same phenomenon occurs, however, even in India, a country subject to a harsh family planning); an imbalance, this, that, despite the current situation of strong economic growth of that country, will certainly be felt soon (to know in detail the cruelties practiced on pregnant women by the Chinese regime can be found in the volumes: "The genocide censored" by Antonio Socci , Piemme, Casale Monf. 2006, p. 18 et seq. and Mission China travel market between the empire and repression "by Bernardo Cervelliera, again, Milan, 2003).
Leading the list of free countries in Europe, in 1967, was England, not surprisingly the home of Aldous Huxley (son of a famous Darwinian biologist, and brother of Julian, the first Director General of UNESCO and tireless advocate of planning policies and pro-abortion still prevalent in the organization), author of "Brave New World - New World," chilling and prophetic novel published around the world. In fact, the UK is now leading the nation in the most unscrupulous techniques of research and experimentation on human beings in earliest possible stage of life: the embryo (for a review see updated. "A year to the" Gianfranco Amato, Faith & Culture, Verona, 2010).
followed by France and Sweden in 1974 (Law Veil), the Netherlands, in 1981, much later, Germany (1992), a recently arrived in Portugal in 2007. A recent leap in the ranking of the "factory of angels", has made the Socialist Zapatero of Spain, where today you can have an abortion without restriction and for eugenic reasons, until the 22nd week, and even for the minors. In Europe, abortion is still banned or allowed with strong restrictions in Poland, Ireland, Malta.
In 1973, the introduction of abortion dates back to the U.S. with the famous case of Roe v. Vade, was very pumped by powerful media deployed to abortion and also thanks to misleading factual reconstruction that affect the verdict of the Supreme Court, which was recognized by Mrs. Norma Mc Corvey, the protagonist of the story, now repented and former feminist rose in the ranks of American pro life movement, which then falsely claimed to have been raped (see Corriere della Sera 19.05.20909, p. 19).
In the U.S., until the law sought by President George W. Bush and introduced in the U.S. in 2003, was admitted to the cd. "Partial-birth abortion" consisting in the killing of the child at an advanced stage of intrauterine life and is extracted from the uterus of the mother by surgical aspiration of the cerebral fluid.
2. Lobbies neo-Malthusian and anti-birth
The U.S., after the Supreme Court's decision in all the states that authorized the federal aboprto, becoming the engine of the international abortion movement through powerful associations "non-profit organization, a global character (such as the Rockefeller Foundation , 's ABCL - American Birth Control League feminist activist Margaret Sander, which merged in' IPPF - International Family Planning Parenthood), which must agiungersi some UN agencies (such as the UNFPA - United Nation Family Planning AIDS, UNICEF), to date planning policies and promote mass sterilization, in particular in developing countries where economic aid are conditioned their adoption by the respective governments (including the European Union, even under the presidency of Romano Prodi, a Catholic, and adopt financial policies of family planning to the third world countries, cf. Lucetta Scaraffia-Eugenia Roccella, "Against Christianity -l 'UN and the EU as a new ideology ", p. 95 et seq., Piemme, Milan 2005).
The spread of anti-birth mentality and abortion, in addition to an array of ideological feminism and radical Communist, is also linked to widespread, constant action of some influential circles "neo-Malthusian" (from the Rev. Thomas Robert Malthus - 1776 to 1834) of which is worth to mention at least "Club of Rome, who in 1972 presented a famous paper (" The Limits of Growth ") based on a computer simulation that had a worldwide impact, although it was panned by scientifically while deployed in a" progressive ", The Economist (see Colin Clarks "The Myth of the population explosion", p. 41-42, Ares, Milano 1973).
These circles, whose members had infiltrated the nerve centers of power, were able to slowly build in Western public opinion a true psychosis of the "demographic bomb", reaching influence, first in developed countries and then in the underdeveloped ones, policy decisions on the family way strongly anti-birth and population control. In this heavy
cultural climate, supported by these centers of power, the press, the radical Pannella and Bonino, Rutelli & c., thanks to obsessive propaganda based on data greatly inflated illegal abortion and female mortality, and thanks to a submissive attitude at least a portion of the marginal Catholic politicians (See F. Angles, op. Cit. 22 et seq.) Abortion arrived in Italy by Law No 194, May 22, 1978, entitled "Rules for the social protection of maternity and on abortion" and bearing the signature at the bottom of three Christian Democrat politicians (John Leone, President of the Republic, Prime Minister Giulio Andreotti and Francesco Paolo Bonifacio Minister of Justice).
3. Abortion in Italy: the "premises" of the Constitutional Court and the Law 194/1978
induced abortion in Italy, was sanctioned by the provisions of Title X ° ("Crimes against the integrity and health of race ") of book II of the Penal Code, dating back to 1930, expressly repealed by art. 22 of L. 194/78.
Jurisprudence extensive use of the institution of the "state of necessity", he declared, however, not without a sometimes excessive "open-mindedness," non-punishable 's abortion when it was deemed necessary to save the life or health of the mother in grave danger.
In 1975 the Constitutional Court, chaired by the same Prof. Bonifacio, who would later become the Minister of Justice, had prepared the ground with a 'major decision (No. 27 of 18.02.1975) in which, while confirming the constitutional basis the protection of the unborn under Article. 2 (fundamental human rights ...), stated that "... there is no equivalence between the right not only to life but also the health of those who already own person, like her mother, and the protection of the embryo, that person must yet become "so opening the possibility that the pregnancy is interrupted every time he continued his" involves the damage or serious risk, medically certified and ... not be avoided, for the health of women ", with the consequent expansion of the concept of state of necessity "(no longer linked to the strict condition of current the danger and the assumption of equivalence of legal positions to protect themselves) as the cause of non-punishment of abortion (see Alfredo Mantovano "Abortion in the legal system of the Italian Republic", in "Voices for a dictionary of thought strong ", edited by John Cantoni, p. 15 et seq., ed. Christianity, 1997).
Law 194 28.ì May 1978, under the politically correct acronym for "VIP" ("abortion"), governs the splitting abortion "in a completely arbitrary intrauterine life into three periods and setting for each of them a different discipline and having as its exclusive benchmark of the health risks of women "(see Mantua, op. cit. p. 16).
In the first 90 days. of gestation (art. 4 and 5) abortion, in fact, is allowed without limits: just the mere statement of the woman picked up by the clinic, the health facility or by the doctor to want to abort her pregnancy for a any reason, objective or subjective, involving a "serious danger" - that nobody has ever found and that probably no one could ever ascertain, given the absolute vagueness of the adjective associated with any subjective interpretation, cf. Massimo Ermini, "Rules of Bioethics" Plus, Pisa, 2005, p. 135 et seq. - For their physical or mental health before the claim is certainly welcomed.
In the second period (between the fourth month of pregnancy and the possibility of independent life of the fetus), abortion is permitted cd. "Therapeutic", understood in a broad sense, ie also for reasons related to mental health of the woman who could be endangered, for example, by the news of a possible malformation of the fetus. "
In the third period, running from the possibility of independent life at birth, abortion is allowed only if it is endangering the lives of women.
This law came up again (demagogic) "Therapeutic abortions to zero, to reduce miscarriages, to assist those immigrants (...) to help the mothers and protect human life from the beginning" (see the report to law by the Hon. Giovanni Berlinguer), offering with any type of counseling assistance act "to remove the causes that might lead women to abortion ... (see art. 2 points. d).
We know that in practice, more than 30 years after its entry into force, this section of law not only has never been applied, but was not even taken into account by the public. The CAV, as everyone knows, are left out of the counseling they may influence the decision of the woman (sic)
aside those illegal immigrants by the thousands each year, continue to practice general indifference in private hospitals visited by respectable ladies VIP, of course, prefer to remain anonymous, the statistics official annual update by the Ministry of Health report more than 5,000,000 abortions: a people who are missing disappeared into thin air, or rather of special waste in landfills, causing the collapse of the population of this country.
The application of this law, case law has also modeled in time the 'voluntary interruption of pregnancy " as a genuine subjective right of the woman whose sole violation, for example, due to an error or an oversight of the doctor who failed to detect promptly the existence of a malformation of the fetus, thereby preventing the removal, results, for it, the imposition of heavy damages to the woman "forced" to accept an unwanted life (among many others, see Cass. Civ. Sec. III, 04/01/2010, No. 13, "Contracts", 2010, 7, 662 note DE FEO, that the failure detection by the practitioner, the presence of severe malformations in the fetus, and the correlative failure to disclose this information to the pregnant woman, the fact must be considered capable of arise in causality with the non-exercise by women, the option to terminate the pregnancy must be considered as meeting a criterion of causal regularity that women, if properly and timely informed of the presence of a malformation that may affect the manifestation of the personality of the unborn child, prefers not to carry the pregnancy to term).
4. The "ordinariness" of abortion, birth control tool.
course, as was guessed, the practice of illegal abortion, unfortunately present, although not with the numbers of pro-abortion propaganda, in certain social and cultural (inter alia, often inconsistent with each other), that it is still illegal in much of the social consciousness, after the liberalization has been accepted gradually, as something quite normal on the assumption that what is allowed by law at the end coincides with what is legitimate and then just do it.
To give a trivial example: the violation of tax laws, as everyone knows, is a widespread phenomenon at all latitudes and yet no one, for that alone, never came to mind to abolish them.
But if, by mere conjecture that to happen, certainly very few would continue to support the state coffers, according to a simple moral imperative (if only because of bad quality of services rendered by it).
The role of law, therefore, is to promote a model of ethical conduct objectively positive and worthy of protection. If it falls under the law is also the principle, and with it, gradually, the ethical and showed that this rule (see Massimi Ermini, op. Cit. P. 135 et seq.).
A serious weak point, therefore, was caused by Law 194 of the general perception of what is, ontologically, an abortion. It
from dramatic reality of life at its beginnings broken for ever, was relegated to hurry serial surgery in the gray of a hospital room distracted by health officials in lab coats white.
In fact, the practice of abortion from the outset has remained free from any serious scrutiny to be from the health point of view that from a legal standpoint, and is, therefore, become a means of last resort birth control that can be at liberty to use whenever there is an unwanted pregnancy, without having to cite any specific reasons.
This well-established stage of "trivialization" of death in the individual consciousness - all experience every day, not only with regard to abortion, but more generally, the growing indifference all'incalzare episodes of increasingly horrifying chronicle - Is making, however, a further leap in quality, obviously the worse, with the abortion drug (RU486), and with the cd. "Emergency contraception".
5. The medical abortion: RU486, NorLevo, She One.
The 'RU486 is an abortifacient found, invented by a French doctor (Etienne Emile Baulieu), which does not provide any direct intervention of medical personnel on the woman's body, which is limited to assume, on doctor's prescription in the tree health, a powerful poison (mifepristone) that causes the death of the embryo in the earliest stages of development followed, after taking the second pill basis of prostaglandins), his expulsion, sometimes at a distance of up to several days and with painful contractions and bleeding (except in some cases even fatal complications, cf. Renzo Puccetti, "The man junk", p. 103 et seq., SEF 2008).
With this system, even without consideration for greater security in terms of their health (according to data from the New England Journal of Medicine, the mortality rate is 10 times higher than a surgical abortion, cf. Renzo Puccetti op . since last. cited above, p. 107,), trying to persuade women to be able to "quietly" abortion in the home. But this is not true. It should be here
mention, albeit en passant, to the events that preceded the entry of RU486 in Italy, including the free supply of the patent of the drug by the pharmaceutical company Exelgyn for fear of new civil cases filed in the U.S. the same, but especially the cases of at least 15 women died from the effects of "side" of his recruitment. For a fuller account, see: "The fable easy abortion, myths and realities of the RU486 pill," to Assuntina Morresi and Eugenia Roccella, Angeli, 2007).
Again certain mystification professionals, who once claimed to want to fight clandestine abortion to the light of sun, this time it is repositioned on a slogan to mark the exact opposite: the abortion must be returned to a private matter of the woman, to be consumed in the 'anonymous.
To put a stop to the abortion pill (the "human pesticide" as defined by Jerome Lejeune) was the Superior Council of Health, with an opinion of 18.03.2010, which has argued that the abortion method can not circumvent the rules imposed by L. 194 seconds when the entire process of any interruption of pregnancy must occur within the facility and under the direct supervision of medical personnel, to protect women's health, pain severe penalties (see Arts. 5, 8, 19) .
It is well known, however, that this does not happen. In most cases, you sign a statement that the woman the same, resigning, assumes full responsibility for the health service in the event of complications.
Women, who once said he wanted to leave by "midwives", today would have us believe that alone can solve the "problem" just a couple of tablets and op-là! The son is gone.
What good, in fact, so many formalities, they ask the abortionists. Why you blush in front of the head nurse of the gossip around the hospital? Why cross the eyes of Callido doctor paid off for life when you can do it all in the silence of the bathroom of your own home without anyone knowing it?
We try to minimize abortion, relegating it closed in the four walls as if the simple act of swallowing a poison pill could exorcise the reality of the termination of a life of its incipit that this gesture implies.
But every woman in his heart, he knows not, and if it falls in the 'deception this is due to the influences of a society that has lost the sense of evil and sin and hates the great task nature has entrusted: to form a new life.
can not exist, then abortion "easy", and does not exist except in the Orwellian Newspeak, an "emergency contraception" or the cd. "Morning-after pill" (NorLevo "or" She One ", the latest drug).
This is nothing more than a disguised form of abortion (possible, because the substance is taken shortly after intercourse, the blind, ie without first doing a pregnancy test) of a human being who has just started his journey in life which is, however, stopped when the mother's uterus and expelled lurk in complete anonymity.
6. Conclusions.
These increasingly sophisticated instruments of death more likely to leave the woman alone in the inner drama of a desperate act and the consequences of unnatural, psychologically, she will forever as proof behind recent statistical studies carried out on women who have abortion (see Renzo Puccetti. "The woman is a victim", The Rudder, No, 86 .. sett.ott 2009).
Only found responsible to any new culture of life and consciousness of the fundamental role of parenting, that institutions must protect and support before anything else, will save our society from the ongoing demographic collapse, the result of its anti-natalist mentality permeated slowly deep in the minds of Italians.
A first step, decisive and urgent, in that direction, is intended to introduce a law that recognizes the legal capacity to the conceptus, thus changing the current wording 'Article 1 of the Civil Code, dating from the distant 1942, that makes the event of birth, changes for which there are already bills in Parliament lying waiting to be discussed (see draft law S. 1915 of 12.01.2009, presented Sen. know Gasparri, Quagliarella Bianconi) .
